1. Who we are?
Anya van der Drift with NIE Y2035820N and with postal address at Carrer Espinoi 11, 08023 Barcelona (hereinafter "My Barcelona School") is the owner of the Website www.mybarcelonaschool.com/ and the School Directory www.mybarcelonaschool.com/school-directory (hereinafter the “Site”).

2. Object
By accessing and using the Site you acquire the status of "User", which implies full acceptance of all the provisions of this Legal Notice and the rest of the "Legal Texts" including this Legal Notice, the Acceptable Use Policy, the Privacy Policy, the Directory Data Privacy, Data Protection Agreement and the Cookies Policy.
This Legal Notice regulates the access, navigation and use of this Site, without prejudice that My Barcelona School reserves the right to modify the presentation, configuration and content of the same, as well as the conditions required for its access and/or use. The access and use of the contents of the Site after the entry into force of its modifications or changes implies the acceptance of the same.
This Legal Notice is part of My Barcelona School and reserves the right to modify the terms and conditions stipulated herein, in whole or in part, by publishing any changes in the same form in which they appear in this Legal Notice or through any type of communication addressed to Users.
3. Use of the Site
The User agrees to make proper, diligent and lawful use of the Site and, in general terms (i) not to use the Site for illicit and/or illegitimate purposes; (ii) not to use the Site to the detriment of My Barcelona School’s interests; (iii) not to use the Site with the purpose of causing damage, inefficiencies, interruptions, saturation, or analogous defects in the functionality of the Site, including the transmission of malware, viruses or similar programs, or to disseminate or publish offensive, racist, denigrating or pornographic content that could cause discomfort to people; (iv) not to break the security measures established by My Barcelona School; (v) not to use the Site for advertising purposes, such as sending spam or other similar ways;
Additionally, the User agrees to use the Site in accordance with the Acceptable Use Policy of My Barcelona School.
The User shall be liable for the breach of any of the aforementioned misuse of the Site, as well as for any loss or damage suffered by My Barcelona School due to a direct or indirect misuse of the Site. For these purposes, My Barcelona School may exercise all the judicial and extrajudicial actions it deems appropriate.
4. Privacy
All personal data provided to My Barcelona School through the Site will be processed according to the Privacy Policy, the Directory Privacy Policy and the Data Protection Agreement.
5. Cookies
The use of cookies on the Site will be regulated in the Cookies Policy.
6. Commercial communications
Provided that the User gives his express consent, or in case of having a contract in force with the User, My Barcelona School will send commercial communications to keep the User updated on all the news, as well as any type of information about My Barcelona School or the services it provides that may be of interest to him/her.
My Barcelona School shall send such commercial communications for as long as the User maintains his/her consent to do so or for as long as the contractual relationship with the User is in force. However, if the User does not wish to receive any more commercial communications, he/she may withdraw his/her consent through the form provided in the commercial communications, or, if applicable, by sending an e-mail to hello@mybarcelonaschool.com.
7. Links
The Site may contain links to other websites in order to complement the services offered to the User. My Barcelona School is not the owner of these websites, so it is not liable for their contents or for the damages that the use of them may cause to the User.
If the User of the Site accesses such websites and the services they offer, My Barcelona School shall not be involved in any type of relationship that may be established between the User and the owners of such websites or any third parties related to them.
Likewise, the owner of a website which intends to insert a link to the Site must obtain prior authorization from My Barcelona School.
My Barcelona School shall not be liable for the contents of those websites in which there is a link to the Site and shall not be involved in any type of relationship that may be established between the owners of such web pages and the Users of the Site.
8. My Barcelona School intellectual property rights
All intellectual and industrial property rights applicable to the Site are owned by My Barcelona School or its licensors and are protected by current national and international legislation. Unless expressly stated otherwise, all rights to the Directory are the exclusive property of My Barcelona School.
This includes, but is not limited to, trademarks, logos, distinctive signs, graphics, interfaces, software, as well as the design, structure of the Site, and the databases that compose the Site and form part of it. The User does not acquire any rights over the Site that have not been expressly authorized by My Barcelona School.
Any use of the Site by the User that has not been expressly authorized in advance by My Barcelona School, whether direct or indirect, for profit or not, is expressly prohibited, and My Barcelona School may take any legal or extrajudicial action it deems appropriate as a result of any infringement of its rights.
9. Liabilities
My Barcelona School has made every effort to ensure that the information on the Site is accurate and up to date. However, My Barcelona School makes no warranties or representations as to the accuracy and currency of the contents of the Site. My Barcelon School is not liable for any errors or omissions in the contents of the Site and reserves the right to change such contents at any time without notice.
The commercial relations between My Barcelona School and the Users are governed by other general conditions or specific agreements, so that the contents of the Site do not prevail over such conditions or agreements and the Users cannot condition the commercial policy that My Barcelona School decides to adopt at any time.
My Barcelona School is not liable for any errors or failures in the operation of the Site, whether intrinsic or due to the characteristics and limitations of the Internet. The User assumes any risk arising from the use of the Internet, including the possible transmission of computer viruses. My Barcelona School does not warrant the uninterrupted operation of the services of the Site and shall not be liable for any damages that may arise from the interruption of the services. In particular, My Barcelona School shall not be liable in circumstances of force majeure such as fires, strikes and power outages or any other unpredictable or unavoidable events, as well as the improper use of the Site by the User in accordance with the provisions of this legal notice.
In any case, My Barcelona School shall only be liable for damages that were foreseen or could have been foreseen at the time of the use of the Site by the User, and which are a direct and necessary consequence of a grossly negligent breach of substantial contractual obligations.
The fact that the Site describes or presents certain services does not imply a commitment by My Barcelona School that such services will be available to the User.
The exclusion of liability and warranties described in this section shall apply to My Barcelona School as well as to its directors, officers, employees and representatives.
10. Modifications
My Barcelona School reserves the right to modify this Legal Notice at any time. Changes or updates to the Legal Notice, as well as to the Acceptable Use Policy, Privacy Policy, Directory Privacy Policy, Data Processing Agreement and/or Cookies Policy will be explicitly notified to the User through a notice on the Site.
